This depends on who did what and which laws govern the situation. You should know that you do not need to be totally blameless in order to recover for your injuries. New Hampshire uses the “modified comparative negligence” rule. This means that an injured party can recover if his or her fault in causing the injury does not reach 51%. If the injury victim is 50% or less at fault, he or she will be entitled to recover financial compensation.
The amount of the injury victim’s actual financial recovery will depend on whether or not he or she is blameless, or partially to blame. The amount of the recovery is reduced by the extent or degree of fault. Therefore, if it is determined that Moe sustained $100,000 in damages, this would result in a recovery of $75,000.
